Statutory Requirements

Relevant Statutory and Regulatory in connection with safety inspection requirement
  1. Section 15 OSHA 1994 subsection (1) stated duty of every employer and self employed person to ensure, so far as is practicable, the safety, health and welfare at work of all his employees.
  2. Section 15 OSHA 1994 subsection (2b) the making of arrangements for ensuring , so far as is practicable, safety and absence of risks to health in connection with the use or operation, handling, storage and transport of plant and substances.
  3. Section 21 FMA 1967, the occupier shall at all times maintain all safety appliances and machinery.
  4. Regulation 18 OSH (Safety and Health Officer) Subsection (b) to inspect the place of work to determine whether any machinery, plant, equipment, substance, appliance or process or any description of manual labour used in the place of work, is of such nature liable to cause bodily injury to any person working in the place of work.
  5. Regulation 18 OSH (Safety and Health Officer) Subsection (c) to assist safety and health committee in any inspection of the place of work for the purpose of checking the effectiveness and efficiency of any measures taken in compliance with the Act or any regulations made under the Act.
  6. Regulation 12 OSH (Safety and Health Committee) subsection (a) a safety and health committee shall inspect the place of work at least once in every three months to ascertain if there is anything prejudicial to the safety and health of person employed therein;
    Provided that the committee may, at anytime, make further inspections of any plant therein or any part of the place of work to check on the effectiveness of the measures taken to ensure the safety and health of persons at the place of work.
